How to E-File a new case?

Question: How to E-File a new case?

Answer:  For e-filing a new case follow the following process:

Step 1. Type user ID: ASHISH KUMAR

             Password: xxxxxxxxxxx

             Captcha: xxxxxxxxxx

              And then Login.

Step2. Go to New Case option in Dashboard Page.

Step 3. For filing the case in High Court choose the Radio button High Court.

             For filing the case in Lower Court choose the Radio button Lower Court.

Step 4. Now fill the following details

a.     State

b.     District

c.      Court Establishing

d.     Matter Type

e.     Case Type

f.       Is MACT Matter : Yes or No

g.     Matter Nature: Urgent or Ordinary

If the details are wrongly typed then click the Reset button and do the necessary corrections.

And then click Submit button if it is OK.

Step 5. Now complete the following table in the next page:

             First of all Information of the complainant/petitioner be submitted which include his

Name

Father’s Name

Date of Birth

Age

Gender

Religion

Caste

Email id

Mobile

Address

State

District

Taluka

Ward

Village

Pin Code

Police Station Code

And then Save these items.

After saving these details the e-filing no. will be displayed on the screen, which can be used for further reference.

After noting the e-filing number, select next you will come on the next page.

Step 6. Now Fill the details of the respondent which will have same particulars which were mentioned in step no.5 and then save and click next.

Step 7: On the next screen you will find Petitioner/Respondent Extra Information which is optional but it is recommended that you must fill the necessary details which include:

Passport Number

Pan Card Number

Fax Number

Phone Number

Alternate Number

Occupation

Nationality

Click Save and then proceed Next.

Step 8: On the next Page you will on the Extra Party Information.

           This page will be used only if there are either more than one petitioner or respondent or both.

Once you save Extra Party Information, thereafter you cannot alter the same, so take proper care while filling the details in Extra Party Information.

 If there is no Extra-Party in the case then directly click next Button.

But if there are Extra Party or Parties then fill up the details of Extra Party Information and clarify whether the Extra Party is of Complainant/Petitioner or on the Respondent/Accused Side.

After this save and click Next button.

Step 9: On the next screen you will be on the Case Details Form.

            Under which you are required to give the following details

a.     Causes of Action

b.     Date of cause of action

c.      Important Information/subject/reason.

d.     Claim Amount.

e.     Prayer

f.       Relief Claim

g.     Dispute arising out of

1.     State

2.     District

3.     Taluka

4.     Village

Now Save these details and Click on Next Button.

Note: There will on option Hide Information, this option will be used in case any direction is given by the law to Hide the Information of both the parties. Normally in matrimonial case the details of the parties are required to be Hide.

Step 10. Now Give Information in respect of:

a.     Act

b.     Section

Now Save these details and click on Next Button.

  Step 11: Now you will be on E-Signing Page

                 For E-Signing you can use:

a.     Aadhar Card

b.     Digital Token

c.      Mobile OTP

Now click on Save and Next button.

Step 12. If you want to upload any document including Petition, Vakalatnama then use Document Information Form in which choose :

a.     Document Type

b.     Document Title

And attach the document which should not exceed 50 MB.

Now Click on Upload button and you will see the document uploaded.

What will happen if I Upload the wrong document?

Then do not worry click on Delete Button to remove the document.

Now after successfully uploading the documents click on the Next Button.

Step 13. Now pay the Court Fees

For payment of the Court Fees, there are two options i.e.

a.     Online

b.     By Challan

Now fill up following details for making the payment of fees:

a.     Fee type

b.     Fee amount

c.      Payment mode

d.     Bank Receipt

e.     Challan/Cheque/DD/E-Challan Number.

f.       Challan/Cheque/DD/E-Challan Date.

g.     Select Party

h.     Upload receipts

Now Click Next and proceed further.

Step 14: After this you will come at the Affirmation Page.

           This affirmation can be send through:

a.     Litigant: By sending the OTP on his registered mobile number for this purpose fill the details of the Litigant name and his mobile.

b.     Advocate:  By sending the OTP on his registered mobile number for this purpose fill the details of the Litigant name and his mobile.

Step 15. To review the complete details in respect of all the details in the document click on the Expand Button.

And then click on Final submit button if each and every particular is correct.

You will get e-filing number.

Now you have filed you case by the process of e-filing.

Step 16: To get the print out of the e-filing acknowledgment.

Click on the Pending Acceptance Button which will show the details of your various e-filings reference number.

 Click on that e-filing number and you will get the e-filing acknowledgment.

Now take the print out of the acknowledgment by clicking the print out button.

You can also see the Parties Information by clicking on the Case Parties option.

Step 17.  Now logout from the Portal by Clicking Logout Button.
